The Judge of Resident Magistrate's Court, rejected all
arguments of advocates of Tundu Lissu, which required Camillus Wambura, general
commander, Investigation Special Zone of Dar ea Salaam (ZCO) to arrive at the
court as a witness, writes Faki sosi.
John Yongolo the Magistrate Court has said that there is no
need of that witness from the fact that, time to deploy defense witnesses
before the court ended.
In this case, the accused Lissu offered words of incitement
to summon President John Magufuli be a 'dictator
Uchwara'.
He was allegedly uttering these words immediately after the
out of court in another case which facing him by giving seditious words through
newspaper of MAWIO.
On 25 September this year, Bernard Kongola, attorney told
the court that they had two witnesses who mentioned as (ASP) Kimweli, Assistant
Superintendent of Police and Staff Sergeant Ndege.
However, attorney Peter Kibatala, who heads the panel of
advocates of Lissu asked the court to order the information given to the
complainant in the case before doing anything, which raised the tension to move
after being challenged by the prosecution.
Kongola lawyer told the court that the plaintiff in this
case is Wambura Camillus Police Commander of Special Zones Dar es Salaam, and
that the complainant is not among the witnesses they intend to call them up.
Responding to those concerns, Kibatala the lawyer claimed
that the report of the complainant is the source of the case, so it is
important to come to court to give evidence because his statements are an
integral part of the case.
The decision of the judge issued earlier today, that decision
rejected the arguments of the defense and the trial will resume on October 5th
this year. The Republic will start giving evidence before the court.
